History

The firm was founded in 1998 by Stuart Forbes and Morris Chochla. From the beginning, they envisioned a different kind of law firm, uniquely positioned to meet the varied needs of insurers and their clients. It was their goal to create a firm that was able to expeditiously find creative, intelligent, and strategic solutions, regardless of the type of file. Over the years, the firm has grown to include new partners and new associates.

These professionals have added valuable expertise. The firm continues the defence of engineers and municipalities on which it was founded, but now practises in a wide range of other specialties, including medical malpractice, professional liability, environmental liability, regulatory matters, directors’ and officers’ liability, and many other types of claims.

The firm continues to grow, but maintains the high standard of service and skill on which it was created. Professional Liability

Since the inception of our firm in 1998, we have defended a wide range of professionals in errors and omissions claims and disciplinary complaints. We have experience in defending engineers, architects, contractors, healthcare providers, accountants, mortgage brokers, insurance brokers, financial planners, and environmental consultants. We have built excellent relationships and contacts with experts in all fields to assist in the defence of professional liability claims and ensure we continually monitor legal developments in this area.

Construction Claims

Defending engineers in construction claims and at discipline hearings has been a major focus of our firm from the outset. We also represent electrical and mechanical consultants, designers, and other parties involved in construction projects. Many of our construction files involve multiple parties, substantial documentation, and complex technical issues. We are known for our innovative approach to such files; we refuse to allow these cases to become unnecessarily large or drawn-out. We have the experience and the knowledge of experts in the industry to find the most appropriate method of successfully resolving each dispute.

Municipal Liability

Forbes Chochla LLP has represented municipal and regional governments since its inception as a firm and continues to do so. We act for municipal agencies and conservation authorities and have experience in varied sources of liability such as road and sidewalk design and condition, occupiers’ liability, personal injury and property damage claims, subrogated losses and environmental liability, to name but a few.

Motor Vehicle Litigation

We act for auto insurers with respect to both tort and accident benefits claims. Our practice is strictly defence-oriented and is designed to come to grips with these claims in as timely and in as cost-effective a manner as possible. We have decades of experience in this area of practice and are well-known in the personal injury bar as determined, experienced, and vigorous in the defence of all claims.

Medical Malpractice and Health Professions Liability

Our lawyers have experience in defending many different types of medical professionals in malpractice claims, and have an extensive knowledge of this particularly complex area of law. We are cognizant of the professional and personal toll such a claim can have on our clients, and work to not only defend the claim but our clients’ reputations as well.

Environmental Claims

We have a unique degree of expertise in this area of litigation. We have acted for insurers, private companies, officers and directors and governmental entities with respect to disputes relating to contaminated properties and remediation issues. We also litigate personal injury claims arising from environmental sources and coverage disputes involving all manner of insurance policies.

Employment Litigation

Forbes Chochla LLP has been called upon to defend employers, management, and other employees in a wide range of claims. Our lawyers have comprehensive expertise in this area which allows us to represent clients in many capacities, including defending wrongful dismissal claims, negotiating terms of dismissal, and defending human rights complaints by former or current employees.

Human Rights Claims

Our lawyers have acted in the defence of clients who have been accused of infringing upon or violating an individual’s human rights. Both in court and before the Human Rights Tribunal, we have experience acting in this capacity, whether the claim is brought in the context of an employment situation or any other relationship. This area of practice requires a deft touch, not only with the courts but with the media and the clients themselves, who have their reputations and standing at stake. We are sensitive to these issues and handle all human rights claims with the seriousness and sensitivity that these cases demand.

Directors’ and Officers’ Liability

Our lawyers have defended officers and directors for a wide variety of organizations, including not-for-profit agencies, professional associations, and regulatory bodies, in litigation arising from negligence, discrimination, wrongful dismissal, and other statutory or common law rights of action. We have a strong history of representing these clients in a way that protects the integrity of the client and is sensitive to the individual organization’s needs.

Property Loss Claims

Forbes Chochla LLP is experienced in dealing with claims for both commercial and personal property damage, including loss in the course of construction, fire, flood, building collapse, and all types of natural disasters. We also have experience in resisting claims of bad faith on the part of insurers. We understand the realities of adjusting and assessing these types of claims, and work closely with other professionals to provide the best defence for our clients.

Insurance Coverage Disputes

Our firm has significant experience in providing advice to insurers on complex coverage issues. We are regularly retained to provide opinions with respect to coverage or to represent insurers in coverage applications. We also regularly act for insurers in priority disputes and provide advice on the drafting of insurance policies. We consider all aspects of each particular situation to provide the best possible counsel, backed by a thorough understanding of the law in this area, both from Canada and abroad.

Subrogation

Forbes Chochla LLP is experienced in proceeding with cost-effective subrogation claims arising from a wide variety of insurance coverages, in a cost-effective and thorough manner.

Appellate Advocacy

Our lawyers are often retained by insurers to appeal decisions or to respond to appeals from major motions and trials. We have been involved in important, precedent-setting developments in insurance and tort law.

Class Actions

We have been retained by insurers and municipalities to defend class actions and to a limited degree we have acted on behalf of plaintiffs in class actions which have no insurance component. Our experience with class actions encompasses a wide variety of issues: we have acted as defence counsel on environmental mass tort claims to class actions involving insurance coverage issues. Regardless of the subject matter, our firm is ready to meet the unique challenges presented by a class action and use our experience and expertise to offer the most effective representation.

Morris specializes in professional errors and omissions, products liability, coverage disputes, and construction claims.

Morris has been a guest speaker at the Canadian Society for Civil Engineering, the Canadian Association of Student Engineers, Lloyds of London, the Architects and Engineers Loss Control Program for Simcoe Erie/ENCON, the Insurance Society of Philadelphia, and the Ontario Bar Association.  He has presented papers at the Annual Meeting of the Canadian Independent Adjusters Association, and at the Ontario Bar Association Annual Institute.  Morris has written papers on the insurers’ duty to defend, coverage issues and a variety of topics related to professional engineers and civil procedure.

Morris graduated from Queen’s University with degrees in Engineering and in Law.  He received his LLM from Osgoode Hall in June of 2011.  He was called to the Ontario bar in 1980.

Natalie defends professional liability, construction and pollution liability claims and represents both insurers and policy holders in complex coverage disputes. She regularly represents mortgage brokers, engineers, contractors, oil burner technicians, insurance brokers, and accountants, among other professionals.

Natalie has presented several seminars with respect to civil litigation and insurance issues. Natalie has also taught a Professional Ethics course for mortgage brokers obtaining their certification. She is a volunteer Circle Keeper with Peacebuilders International, an organization that works with youth to assist them in finding ways to make amends for criminal activity.

Kim’s practice is focused on professional negligence and liability law, products liability, municipal liability and occupiers’ liability law.

 She regularly defends insurance agents and brokers, mortgage specialists, financial advisors, home and building inspectors, and various other professionals. Kim has co-authored a paper on financial advisor liability. Kim has defended her clients in regulatory proceedings, and well as in the legal arena. She has appeared before the Human Rights Tribunal, the Workplace Safety and Insurance Appeals Tribunal, the Mutual Funds Dealers Association, the Ontario Superior Court of Justice, the Ontario Court of Appeal, the Alberta Court of Queen’s Bench, the Nova Scotia Supreme Court, and the Supreme Court of Newfoundland and Labrador.

 Kim received her Bachelor of Arts degree from the University of Calgary and her Bachelor of Laws degree from the University of Windsor. Stuart has acted as counsel in over 200 trials and has appeared at trial and appellate courts in Ontario, as well as in the Supreme Court of Canada. He specialized in civil litigation.  In January 2016 Stuart became Counsel to the firm.  He also offers his services as a mediator through Coe ADR Management.

Stuart was called to the Ontario Bar in 1966 after graduating from Osgoode Hall Law School. He was appointed Queen’s Counsel in 1980.

Voula practises in all areas of civil defence litigation with a focus on medical malpractice, professional liability, municipal liability, casualty claims, and coverage disputes.   She has appeared as counsel before various levels of court in Ontario and has represented clients at several administrative tribunals, including the Canadian Human Rights Tribunal.

Voula received her law degree from the University of Manitoba in 2006. She received the Jack Rice Memorial Prize for highest standing in Administrative Law. Prior to attending law school, Voula completed a Bachelor of Arts with a Major in Classical Studies and Philosophy. She graduated with Honours.

Jennifer joined the firm as an articling student in 2009 and returned to the firm following her call to the bar in 2010.

Prior to joining Forbes Chochla LLP, Jennifer graduated from Osgoode Hall Law School where she was involved in the Innocence Project, which assists those who claim to be wrongfully convicted of serious crimes.  She also received prizes for the highest standing in criminal law and labour and employment law.

Jennifer also holds a Bachelor of Environmental Studies (Hons.) in Environment and Business from the University of Waterloo, where she graduated on the Dean's Honour List.

Jennifer practises in all areas of civil defence litigation, with a focus on professional liability, personal injury, employment litigation and environmental claims. She regularly represents mortgage brokers, insurance brokers, accountants, and oil burner technicans, among other professionals.

Nicole attended law school at the University of Manitoba and obtained her J.D. in 2011. She received awards for the highest standing in Criminal Law and Negotiation. In her third year, Nicole won the school’s Negotiation Competition and went on to compete in the ABA’s Negotiation Moot. Prior to attending law school, Nicole completed her Bachelor of Arts at McMaster University with a major in English Literature. She graduated with honours.

      Rose has been a member of Forbes Chochla LLP since February 1991. She began as a Senior Assistant and has been the Office Manager since 1998.

      Rose is an active member in TLOMA (The Law Office Management Association) since 2002 and in 2010 received her Joint Health and Safety Certificate.

Our articling students frequently join us as associates following their call to the bar, and one of our partners first joined the firm as a student.

      Members should have their insurance particulars readily available, as well as a concise summary of the pertinent facts and issues. All records will be maintained by FORBES CHOCHLA LLP. Limited information about the calls can be shared with the insurance program administrators, upon request. However, solicitor-client privilege rules will apply to all conversations administered through the legal helpline.

      THE SCOPE OF THE LEGAL HELPLINE

      The helpline is intended to provide summary, preventative legal advice pertaining to professional conduct issues that could otherwise result in disciplinary complaints or malpractice actions.

      The helpline does not provide legal advice to other types of legal issues, such as employment contract negotiations, contract review, or other issues which do not have implications for disciplinary or malpractice actions.

      PLEASE NOTE: If you have already received a notice of complaint or lawsuit, you should contact your insurance broker. We are not agents of your insurance broker, thus should you become aware of an actual complaint, your insurance broker should be contacted directly. Furthermore, any questions about insurance policies including types of coverage, or limit amounts, should be directed to your insurance broker.

      What is personal information?

      Personal information is information about an identifiable individual.  Personal information includes information that relates to their personal characteristics (e.g., gender, age, income, home address or phone number, ethnic background, family status), their health (e.g., health history, health conditions, health services received by them) or their activities and views (e.g., religion, politics, opinions expressed by an individual, an opinion or evaluation of an individual).  Personal information is to be contrasted with business information (e.g., an individual’s business address and telephone number), which is not protected by privacy legislation.

      The collection, use & disclosure of personal information

      We only collect, use and disclose personal information to serve our clients.  The primary purpose for collecting personal information is to provide legal advice and services.  Where our client is an individual, we collect information about the client’s legal issue including anything the client might have done or said that might affect their legal situation, so that we can advise the client as to their legal rights and responsibilities, their options for addressing the issue and then to carry out their instructions.

      Wherever possible we collect your personal information directly from you at the start of a retainer and in the course of our representation.  At times we may obtain information about you from other sources (e.g., from your insurance company and/or their affiliates; a government agency or registry; files of consumer reporting agencies; your accountant; your employer, past and present; other lawyers and law firms or medical professionals.

      Forbes Chochla may disclose personal information to organizations that perform services on behalf of the firm.  Personal information will only be provided to such organizations if they agree to use such information solely for the purposes of providing services to Forbes Chochla and under the instruction of Forbes Chochla and, with respect to that information, to act in a manner consistent with the relevant principles articulated in this policy.

      Please note that there are circumstances where the use and/or disclosure of personal information may be justified or permitted or where Forbes Chochla is obliged to disclose information without consent.  Such circumstances may include:

      • Where required by law or by order or requirement of a court;
      • When the legal services we are providing to you requires us to give your information to third parties (i.e. during examinations for discovery) your consent will be implied, unless you tell us otherwise;
      • When we engage a third party to provide administrative services to us (like process servers or archival file storage) and the third party is bound by our privacy policy;
      • When we engage expert witnesses on your behalf;
      • When we engage other law firms on your behalf;
      • Where it is necessary to establish or collect monies owing to Forbes Chochla;
      • Where the information is public.

      Where obliged or permitted to disclose information without consent, Forbes Chochla will not disclose more information than is required.

      Retention and destruction of personal information

      Forbes Chochla keeps personal information only as long as it is required for the reasons it was collected.  The length of time we retain information varies, but it will be only for as long as is necessary to have sufficient information to respond to any issues that may arise at a later date.  When the personal information is no longer required for Forbes Chochla’s purposes, we have procedures to destroy, delete, or convert it into an anonymous form.

      Security

      Forbes Chochla takes all reasonable precautions to adequately protect your personal information from loss and unauthorized access, modification or disclosure.  Some of the steps taken to protect your information are:

      • premises security;
      • restricted file access to personal information;
      • deploying technological safeguards like security software and firewalls to prevent hacking or unauthorized computer access;
      • internal password and security policies.

      Employment enquiries

      If you apply to Forbes Chochla for a job, we need to consider your personal information as part of our review process.  We normally retain information from candidates after a decision has been made for a period of six months, unless you ask us not to retain the information.  If we offer you a job, which you accept, the information provided by you will be retained in accordance with our privacy procedures for employee records.

      Changes to this privacy policy

      As part of our commitment to inform and update you on the information we collect, how we use it and under what circumstances we disclose it, we may change our Privacy Policy from time to time and any changes will be effective from the time they are posted.  We encourage you to refer back to it on a regular basis.
